1. PURPOSE OF THIS NOTICE

This notice is made available to retailers, distributors and online marketplaces selling Invoxia GPS trackers to the general public.

It provides the pre-contractual information required by Regulation (EU) 2023/2854 of 13 December 2023, known as the "Data Act", regarding data generated by the use of Invoxia GPS trackers and associated services.

This notice may be made available to consumers before purchase, including by URL link, QR code, online product page or any equivalent medium.

2. CONNECTED PRODUCTS CONCERNED

This notice applies to the following products:

Invoxia Tracker GPS Classic;
Invoxia Tracker GPS Mini;
Invoxia Tracker GPS Pro;
Invoxia Tracker GPS Pro Max.

These products are connected GPS trackers designed in particular to locate a tracked item, asset or object, depending on the relevant model and enabled features.

Use of the tracker may require a mobile application, a user account, network connectivity, a subscription or an associated digital service provided by Invoxia.

3. DATA THAT INVOXIA GPS TRACKERS MAY GENERATE

Depending on the model, selected configuration and actual use of the product, Invoxia GPS trackers may generate or collect the following categories of data:

tracker location data;
movement, activity or inactivity data;
technical data relating to the operation of the tracker;
data relating to battery level, network or connectivity;
technical identifiers of the product;
data relating to the association of the tracker with a user account;
usage data relating to the application or associated service;
data necessary for security, diagnostics, maintenance, support and service improvement.

Some data may be generated automatically by the tracker or by the associated service when the product is active, connected or configured to transmit information.

4. DATA FORMAT

Data generated by Invoxia GPS trackers or by associated services may be processed in structured, commonly used and machine-readable technical formats.

The formats actually available may vary depending on the nature of the data, the product model, the associated service and applicable technical, security or confidentiality constraints.

5. ESTIMATED DATA VOLUME

The volume of data generated depends in particular on:

the tracker model used;
the location frequency;
the duration of use;
the settings chosen by the user;
the availability of connectivity;
the features enabled in the application or associated service.

As an indication, data generated by a GPS tracker mainly consists of technical and location data with a low individual data volume, but which may be generated regularly or repeatedly during the period of use of the service.

6. CONTINUOUS OR REAL-TIME GENERATION

Depending on the model, product configuration, subscription and network availability, Invoxia GPS trackers may generate or transmit certain data on a regular, continuous or near real-time basis.

Real-time availability may depend on technical factors, including network coverage, battery status, power-saving settings, service interruptions or product usage conditions.

7. DATA STORAGE

Depending on their nature, data may be stored:

temporarily on the tracker itself;
in the associated mobile application;
on the servers or cloud infrastructure used to provide the service;
in technical systems required for security, support, diagnostics, billing or user account management.

The retention period depends on the relevant category of data, the purposes of processing, applicable legal obligations and service settings.

8. ACCESS, EXTRACTION OR DELETION OF DATA

Users may request access to data generated by the use of their Invoxia GPS tracker, under the conditions provided by the Data Act and, where personal data is concerned, by the GDPR.

Where technically possible and legally applicable, data may be provided in a structured, commonly used and machine-readable format.

Certain requests may be limited or refused where necessary to ensure product or service security, confidentiality, protection of trade secrets, third-party rights or compliance with personal data protection rules.

Users may request that certain data be transmitted to a third party of their choice, under the conditions provided by the Data Act.

The third-party recipient may not use the data received to develop a connected product competing with the relevant Invoxia GPS trackers. The third-party recipient must also comply with applicable confidentiality, security and personal data protection rules.

10. PERSONAL DATA

Certain data generated by the use of Invoxia GPS trackers may constitute personal data where it is associated with an identifiable user, in particular through a user account, a mobile application, a subscription or a location history.

The Data Act does not replace the GDPR. Where personal data is concerned, its processing remains subject to applicable personal data protection rules.

11. ROLE OF RETAILERS

Retailers, distributors and marketplaces selling Invoxia GPS trackers are not data holders of the data generated by the use of Invoxia GPS trackers.

Their role is to make this notice available to consumers before purchase, in particular on online product pages, in store or through a URL link/QR code provided by Invoxia.

Requests relating to data generated by the use of the tracker must be addressed to Invoxia, according to the methods indicated in this notice.

12. REGULATORY REFERENCE

This notice is prepared with reference to Regulation (EU) 2023/2854 of 13 December 2023 on harmonised rules on fair access to and use of data, in particular Article 3 on pre-contractual information concerning connected products and related services.
